Widow files suit against late husband's employer after heart attack

SAN FRANCISCO – A fisherman's widow alleges her husband had a heart attack as a result of an unsafe working environment.

Men Nguyen, surviving spouse of Toan Tran, filed a complaint on July 15 in the U.S. District Court for the Northern District of California against David Tibbles, Ocean Angel IV LLC and Does 1 through 10 alleging negligence and other counts.

According to the complaint, the plaintiff alleges that Toan Tran suffered a heart attack while performing his duties as a crewman on the Ocean Angel IV, which caused his death. The plaintiff holds David Tibbles, Ocean Angel IV LLC and Does 1 through 10 responsible because the defendants allegedly failed to make sure that Toan Tran had a reasonably safe working environment and that he was not overworked.

The plaintiff requests a trial by jury and seeks general, special and other allowable damages, interest, consequential damages, all legal fees and any other relief as the court deems just. She is represented by David M. Lilienstein of DL Law Group in San Francisco.
