Man seeks long-term disability benefits from Unum Life

LOS ANGELES – A cabinet maker and carpenter for Knotts Berry Farm alleges he was wrongfully denied long-term disability benefits.

Kevin Hornick filed a complaint on July 15 in the U.S. District Court for the Central District of California against the defendants alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in January 2015, he became disabled but was denied any long-term disability benefits by the defendant. The plaintiff holds Unum Life Insurance Co. of America and Does 1 to 10 responsible because the defendants allegedly upheld their decision to deny plaintiff's disability benefits based on the claims of their in-house medical providers instead of the opinion of his personal physician.

The plaintiff seeks payment of disability benefits payable at the rate of $2,800 from May 5, 2015, to the present including interest, all legal fees and any other relief as the court deems just. He is represented by Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino.
