– An Alameda County couple alleges that they purchased a Ford vehicle with a defective transmission.
Sheryl L. McGowan and Kirk McGowan filed a complaint on July 19 in the U.S. District Court for the Northern District of California against
Ford Motor Co. and Does 1 through 75 alleging violation of the Song-Beverly Consumer Warranty Act, the Magnuson-Moss Warranty Act and the Unfair Competition Law.
According to the complaint, the plaintiffs allege that on Oct. 28, 2012, they purchased a 2013 Ford Focus equipped with a Dual PowerShift six-speed (DPS6) transmission, which they claim caused jerking, acceleration issues and other problems. The plaintiffs hold Ford Motor Co. and Does 1 through 75 responsible because the defendants allegedly failed to disclose to plaintiff and their consumers the problems with vehicles that are equipped with a DPS6 transmission.
The plaintiffs request a trial by jury and seek general damages, rescission of the purchase contract, incidental and consequential damages, punitive and statutory damages, equitable and injunctive relief, interest, all legal fees and any other relief as the court deems just. They are represented by Hallen D. Rosner, Jeffrey L. Le Pere and David L. Herman of Rosner, Barry & Babbitt LLP in San Diego.
