Dietary supplement marker alleges patent for MigreLief was infringed

LOS ANGELES – A Westlake Village company that sells the MigreLief supplement for treating migraines alleges a Utah company sells a similar product.

Akeso Health Sciences LLC filed a complaint on July 18 in the U.S. District Court for the Central District of California against Nutraceutical Corp. alleging patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages as the result of its patent, which concerns the treatment of migraine headaches, being infringed. The plaintiff holds Nutraceutical Corp. responsible because the defendant sells Migra-Clear Ultra, which allegedly infringes at least 16 claims of plaintiff's '450 patent.

The plaintiff requests a trial by jury and seeks order the defendant to pay actual damages, lost profits, other damages, interest, increased damages of three times the compensatory damages, all legal fees and any other relief as this court deems just.
