Suit filed against city of Davis over wage allegations

SACRAMENTO – A class-action has been filed against the city of Davis by an employee who alleges he was not properly paid for all hours worked.

Robert Weist filed a complaint on behalf of all similarly situated individuals on July 20 in the U.S. District Court for the Eastern District of California against the city of Davis alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime premiums by the defendant. The plaintiff holds the city of Davis responsible because the defendant allegedly failed to pay any overtime compensation at a rate of one-and-one-half to plaintiff for all hours worked in excess of 40 per workweek.

The plaintiff requests a trial by jury and seeks order a complete and accurate accounting of all compensation plaintiff is entitled to, monetary damages in the form of back pay compensation, liquidated damages, interest, all legal fees and any other relief as the court deems just.
