SAN FRANCISCO – A San Luis Obispo man has filed a class-action suit against his employer alleging he was not paid the proper overtime wages.
Israel Padron filed a complaint on behalf of all others similarly situated on July 20 in the U.S. District Court for the Northern District of California against Golden State Phone & Wireless and Does 2 through 10 alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between October 2012 and September 2015, he worked for more than 40 hours per workweek without being paid proper overtime wages. The plaintiff holds Golden State Phone & Wireless and Does 2 through 10 responsible because the defendants allegedly miscalculated the overtime ray of pay because they did not include the value of bonuses and commissions.
The plaintiff requests a trial by jury and seeks compensatory, consequential, general and special damages, liquidated damages, restitution, interest on all due and unpaid wages, all legal fees and any other relief as the court deems just.
