SAN FRANCISCO – A San Jose software company has filed suit against several companies alleging it sold counterfeit versions of its software.

Adobe Systems Incorporated filed a complaint on July 22 in the U.S. District Court for the Northern District of California against A & S Electronics Inc., doing business as Trustprice; Spot.Me Products LLC; Allan Z. Lin; Budget Computer; Computechsale LLC; Expresscomm International Inc.; Fairtrade Corp.; FCO Electronic; ITR Consulting Group LLC; Reliable Business Partner Inc.; Lester Wiegers; Ultraelectronics; and Does 1-10 alleging trademark infringement, false designation of origin and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation as the result of unauthorized copies of its software being sold to consumers by the defendants. The plaintiff holds the defendants responsible because the defendants allegedly distributed and offered for sale unauthorized copies of plaintiff's software bearing the same trademark as plaintiff.

The plaintiff requests a trial by jury and seeks award plaintiff all profits and damages derived from the unlawful acts, actual damages, statutory damages, injunction against the defendant, treble damages, all legal fees and any other relief as the court deems just. It is represented by Christopher Q. Pham, Marcus F. Chaney and Jason R. Vener of Johnson & Pham LLP in Woodland Hills.
