Widow alleges Metropolitan Life wrongfully denied benefits

SAN FRANCISCO – A woman has filed suit against her late husband's insurer alleging wrongful denial of benefits.

Petra Heng filed a complaint on July 22 in the U.S. District Court for the Northern District of California against Metropolitan Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2012 after her husband's death, she filed a claim for accidental death and dismemberment insurance benefits from the defendant. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant denied the benefits claiming that there were no such benefits in place on her husband's policy at the time of his death, which the plaintiff claims is not true.

The plaintiff seeks special, general and other damages, all legal fees and interest, and any other relief as the court deems just. She is represented by E. Gerard Mannion and Kelly M. Mannion of Mannion & Lowe in San Francisco.
