LOS ANGELES – A Los Angeles business has filed suit against a New Jersey and Florida businesses alleging they manufactured garments using fabric similar to the plaintiff's copyrighted designs.

Neman Brothers & Associates Inc. filed a complaint on July 26 in the U.S. District Court for the Central District of California against Burlington Stores Inc., doing business as Cohoes Fashions Inc., Lagaci Inc. and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages as the result of its designs being used and distributed without its authority by the defendants. The plaintiff holds Burlington Stores Inc., Lagaci Inc. and Does 1-10 responsible because the defendants allegedly sold garments that bear a confusingly similar design to plaintiff's fabric on their online and retail stores.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's copyrights, award all profits to plaintiff, statutory damages, all legal fees and interest, and any other relief as the court deems just.
