Photography providers allege Nevada business used copyrighted photos

Copyright 08

LOS ANGELES – Two providers of entertainment-related photos of celebrities allege their copyrighted works were used without authorization by a Nevada business.

BWP Media USA Inc., doing business as Pacific Coast News, and FameFlynet Inc. filed a complaint on July 26 in the U.S. District Court for the Central District of California against CC Marketing & Advertising LLC, doing business as The Guardian Express, and DiMarkco Chandler alleging copyright infringement.

According to the complaint, the plaintiffs allege that they suffered damages as the result of their photographs being used without their authority and consent by the defendant. The plaintiff holds CC Marketing & Advertising LLC and DiMarkco Chandler responsible because the defendants allegedly featured plaintiffs' copyrighted photographs on their website.

The plaintiff seeks statutory damages of up to $150,000 per infringement, actual damages and disgorgement, permanent injunction against the defendant, all legal fees and any other relief as the court deems just. They are represented by Craig B. Sanders of Sanders Law PLLC in Garden City, New York.
