Motion Picture Industry plans allege contributions were not paid

LOS ANGELES – Trust funds for a labor group allege an employer did not pay contributions for a period of almost four years.

Board of directors of the Motion Picture Industry Pension Plan; board of directors of the Motion Picture Industry Individual Account Plan; board of directors of the Motion Picture Industry Health Plan filed a complaint on Aug. 3 in the U.S. District Court for the Central District of California against S&L Tramondo Inc., doing business as Alternative Metal Supply, Studio Division and Alternative Metal Supply - Studio Division Inc. alleging breach of contract and violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs holds S&L Tramondo Inc., doing business as Alternative Metal Supply, Studio Division and Alternative Metal Supply - Studio Division Inc. responsible because the defendants allegedly failed to pay monthly contributions on behalf of their employees from Oct. 25, 2006 to May 4, 2010.

The plaintiffs seek unpaid contributions of $7,938.78, interest rate of 1 percent per month on all unpaid audit contributions, liquidated damages, auditors' fees, all legal fees and any other relief as the court deems just. They are represented by Elizabeth Rosenfeld, Kathryn J. Halford and Nicholas I. Starkman of Wohlner Kaplon Cutler Halford & Rosenfeld in Encino.
