Woman seeks reinstatement of disability benefits from LINA

LOS ANGELES – A woman alleges she was terminated from receiving disability benefits dispute still being disabled according to the terms of the plan.

Cheryl Danylchuk filed a complaint on Aug. 11 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2013, she became disabled due to severe low back pain and applied for and received disability benefits from the defendant until the defendant terminated the benefits on Aug. 27, 2014. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied plaintiff's claims for disability benefits despite still being disabled according to the terms of the plan.

The plaintiff seeks award of benefits due to her plus interest, any other benefits from the plan she is entitled, award future disability benefits to plaintiff for as long as she remains disabled, all legal fees and any other relief as the court deems just. She is represented by Franks N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
