LOS ANGELES – A man claims he was sent spam texts from two individuals affiliated with dental restoring and enhancing services.
Jonathan Weisberg filed a complaint on behalf of all others similarly situated on Aug. 12 in the U.S. District Court for the Central District of California against
James McFadden and Dan Pinar alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in January, he was contacted on his cellular telephone via text message by the defendants with advertisements. He claims he was never a customer of the defendants and did not provide his number to them. The plaintiff holds James McFadden and Dan Pinar responsible because the defendants allegedly used an automatic telephone dialing system to contact plaintiff.
The plaintiff requests a trial by jury and seeks statutory damages for each and every violation, injunctive relief and any other relief as the court deems just. He is represented by Todd M. Friedman, Meghan E. George and Adrian R. Bacon of The Law Offices of Todd M. Friedman PC in Woodland Hills.
