Photographer files suit against Coldwell Banker Real Estate, agent for allegedly using his copyrighted photograph

LOS ANGELES — An individual has filed suit against Coldwell Banker Real Estate LLC, Tom Romaniw and Does 1-10, citing alleged copyright infringement after the plaintiff claims to have found his copyrighted photograph on the defendants' website.

Dennis Hill filed a complaint on Aug. 12 in U.S. District Court for the Central District of California against the defendants, alleging that they used the plaintiff's copyrighted photograph without the plaintiff's authority.

According to the complaint, the plaintiff alleges that he sustained damages from his copyrighted photograph being used without his authority. The plaintiff holds Coldwell Banker Real Estate LLC, Tom Romaniw and Does 1-10 responsible because the defendants allegedly used the plaintiff's photograph on their website.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing plaintiff's copyrighted photograph and to remove the photograph from their website, catalogs and other marketing and advertising materials, award profits and damages to plaintiff plus any monetary advantage gained by the defendant, statutory damages in the sum of up to $150,000, all legal fees and interest and any other relief as the court deems appropriate. The plaintiff is represented by Stephen M. Doniger, Scott Alan Burroughs and Justin M. Gomes of Doniger/Burroughs in Venice.
