LOS ANGELES – The inventor and seller of hookahs and related products alleges counterfeit versions of its patented products are being sold.
Albert Kirakosian and Kiraco LLC filed a complaint on Aug. 15 in the U.S. District Court for the Central District of California against J&L D Sunset Wholesale & Tobacco, Wholesale Palace Inc., et al. alleging patent infringement, trademark infringement, counterfeit, unfair competition and other counts.
According to the complaint, the plaintiffs allege that they suffered damages to their business from their patent and Apple on Top trademark being infringed. The plaintiffs holds the defendants responsible because the defendants allegedly sold counterfeit product that infringes the plaintiffs' patent as well as bearing almost the same packaging as plaintiffs' products, which they allege may cause confusion and/or deceive consumers.
The plaintiffs request a trial by jury and seek damages, profits, statutory damages, punitive damages, treble damages, destruction of all infringing materials, restitution, to enjoin the defendants, exemplary damages, all legal fees and any other relief as the court deems just.
