Former employees fights for canceled disability payments, claims breach of contract

SAN FRANCISCO — A former employee has filed a claim against his disability plan administrators for allegedly denying disability payments. 

Elgin K. Cox filed a complaint on Aug. 15 in U.S. District Court for the Northern District of California against Allin Corp. Plan and Unum Life Insurance Co.of America, citing alleged breach of contract.

According to the complaint, the plaintiff alleges that in November 2008, he became disabled and was initially being paid disability benefits until the plan was terminated effective April 2011. The plaintiff holds Allin Corporation Plan and Unum Life Insurance Company of America responsible because the defendants allegedly upheld its decision to deny further payments to plaintiff for disability benefits.

The plaintiff seeks benefits due plus interest, interest rate of 10 percent per annum, $500,000 in attorneys fees and any other relief as the court deems appropriate. He is represented by Laurence F. Padway of Law Offices of Laurence F. Padway in Alameda.
