Cancer patient seeks long-term disability payments after Anthem Life Insurance Co. allegedly canceled them

LOS ANGELES — A former employee with stage three tonsillar cancer has filed suit against a life insurance company after he was allegedly denied long-term disability payments.

Stephen Clark filed a complaint on Aug. 16 in U.S. District Court for the Central District of California against Anthem Life Insurance Co. and Does 1 to 10, alleging that they denied his claim for disability benefits.

According to the complaint, the plaintiff alleges that he became disabled from the treatments needed to treat his cancer and was initially paid disability benefits until they were terminated in December 2015. The plaintiff holds Anthem Life Insurance Co. and Does 1 to 10 responsible because the defendants allegedly denied further payment to the plaintiff's disability benefits despite still being disabled according to the terms of the plan.

The plaintiff seeks damages, payment of long-term disability benefits at the rate of $2,424 per month from Dec. 8, 2015, until present time and continuing plus interest, all legal fees and any other relief as thecourt deems appropriate. The plaintiff is represented by Bernard R. Schwam of Law Offices of Bernard R. Schwam in Encino.
