SAN DIEGO – A woman alleges a federal employee injured her when the cooler he was pushing fell on her.
Minerva Chavez filed a complaint on Aug. 19 in the U.S. District Court for the Southern District of California against The United States of America, Commissary, Department of the Navy, Malu Barlett and Does 1-20 alleging negligence.
According to the complaint, the plaintiff alleges that on May 24, 2013, she held open the back door of the commissary for defendant Barlett, who was pushing a heavy cooler. The suit states that the wheels of the cooler caught a damaged strip on the door and caused the cooler to fall over and strike the plaintiff, knocking her to the ground. She alleges the fall caused her to injure her leg, hip and knee.
The plaintiff holds The United States of America, Commissary, Department of the Navy, Malu Barlett and Does 1-20 responsible because the defendants allegedly failed to exercise reasonable care and taken measures to correct a dangerous condition.
The plaintiff requests a trial by jury and seeks judgment against defendants, damages, costs of suit and other relief as the court may deem just. She is representing herself.
