Former employee claims company allegedly refused a doctor's visit after he was injured

Medical malpractice 02

TAMPA — A former employee has filed suit against his previous employer for allegedly preventing him from seeing a physician for a shoulder injury, then purportedly forcing him to resign.

Robert Valoy filed a complaint on Aug. 19 in the Tampa Division of the Middle District of Florida against Lasalle Bristol Corporation, alleging that the employer refused the plaintiff's request to see a physician for his shoulder injury.

According to the complaint, the plaintiff alleges that in April 2016, he suffered a shoulder injury and experienced retaliation when he asked for time off to go see a physician. The plaintiff holds Lasalle Bristol Corporation responsible because the defendant allegedly discharged the plaintiff in retaliation for asking for time off.

The plaintiff requests a trial by jury and seeks damages, lost wages and benefits, interest, liquidated damages, reinstatement, all legal fees and any other relief as the court deems just. He is represented by Frank M. Malatesta of Malatesta Law Office in Venice.
