SAN FRANCISCO – A Napa winemaker alleges two wines it produced for its 10th anniversary were completely or partially destroyed by a filtration system.

Hollywood Classic LLC filed a complaint on Aug. 22 in the U.S. District Court for the Northern District San Francisco Division of California against American Tartaric Products Inc., doing business as ATPGroup, and Does 1 to 10 alleging negligence, strict product liability and other counts.

According to the complaint, the plaintiff alleges that it arranged with the defendant to provide cross-flow filtration to its 10th anniversary 2014 Black Label and 2014 Silver Label Cabernet Sauvignon, except defendant's equipment, filters, products, and technical personnel had destroyed/altered the wines beyond recovery. As a direct result of the allegedly defective cross-flow filtration, plaintiff claims it has suffered substantial damages.

The plaintiff holds American Tartaric Products Inc. and Does 1 to 10 responsible because the defendants allegedly failed to use proper skill and judgment, failed to maintain its and clean equipment and failed to hire/supervise competent employees.

The plaintiff requests a trial by jury and seeks judgment against defendants, damages, interest, costs of suit and other relief that the court deems proper. It is represented by Eric J. Schindler and Michelle J. Berner of Kroesche Schindler LLP in Irvine.
