LOS ANGELES – A Los Angeles County company is alleged to owe more than $300,000 in unpaid contributions to several labor union funds.

Trustees of the Southern California IBEW-NECA Pension Plan, trustees of the Southern California IBEW-NECA Defined Contribution IBEW-NECA Defined Contribution Trust Fund, trustees of the Southern California IBEW-NECA Health Trust Fund, et al. filed a complaint on Aug. 23 in the U.S. District Court for the Central District of California against Sage Electrical Co. alleging breach of written collective bargaining agreements and violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant submitted a report in July stating it owed the plaintiffs $345,202.10 in fringe benefit contributions. The suit also states that in November 2015, the parties entered into an agreement for the defendant to pay contributions it owed from August 2015 to September 2015.

The plaintiffs holds Sage Electrical Co. responsible because the defendant allegedly breached its bargaining agreement with plaintiff by failing to make its monthly contributions on behalf of its employees and for failing to make payments per the settlement agreement made in 2015.

The plaintiffs seek unpaid fringe benefit contributions, damages for breach of the settlement agreement, liquidated damages, interest, all legal fees and any other relief as the court deems just. They are represented by J. Paul Moorhead of Laquer, Urban, Clifford & Hodge LLP in Pasadena.
