Woman claims Target's aloe vera gel doesn't contain aloe

SACRAMENTO – A Sacramento woman alleges a retail store chain's brand of aloe vera gel is deceptively advertised and has filed a class-action suit.

Susan Nazari filed a complaint on behalf of all others similarly situated on Aug. 23 in the U.S. District Court for the Eastern District of California against Target Corp. alleging violation of False Advertising Law, the Consumer Legal Remedies Act and other counts.

According to the complaint, the plaintiff alleges that she suffered damages from being misled into buying a falsely advertised product. The plaintiff holds Target Corp. responsible because the defendant allegedly advertises its Up & Up Aloe Vera Gel product as containing pure aloe vera, but independent lab tests reportedly found that the product does not contain any actual aloe vera.

The plaintiff requests a trial by jury and seeks actual damages, restitution, disgorgement, all legal fees and interest and any other relief as the court deems just. She is represented by Michael F. Ram and Susan Brown of Ram, Olson, Cereghino & Kopczynski in San Francisco and Jonathan N. Shub of Kohn, Swift & Graf PC in Philadelphia.
