FRESNO – A Parlier restaurant is accused of not paying overtime wages to its employees and for providing false records to the U.S. Secretary of Labor.

U.S. Secretary of Labor Thomas E. Perez filed a complaint on Aug. 23 in the U.S. District Court for the Eastern District of California, Fresno Division against Colima's Carniceria Y Taqueria, Maria Cobian, and Martin Cobian alleging violations of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that the defendants allegedly failed to pay their employees any overtime premium for hours worked that exceeded 40 per week. The plaintiff also claims the defendants failed to maintain records for their employees, provided false records to the plaintiff to conceal FLSA violations, and discriminating against employees who sought their FLSA rights.

The plaintiff seeks permanently enjoin the defendants, unpaid overtime compensation due to their employees, liquidated damages, compensatory damages, all legal fees and interest and any other relief as the court deems just. He is represented by Janet M. Herold, Susan Seletsky and Sonya P. Shao of United States Department of Labor in Los Angeles.
