Company alleges Bacardi's Untameable mark infringes its own Untamed mark

LOS ANGELES – A Cyprus liquor company alleges Bacardi infringed on its marketing campaign and trademark for rum and whiskey.

Lodestar Anstalt filed a complaint on Aug. 25 in the U.S. District Court for the Central District of California against Bacardi & Co. Limited, Bacardi U.S.A. Inc. and Bacardi Limited citing trademark infringement, unfair competition and other counts.

According to the complaint, the plaintiff alleges that its copyrighted "Untamed" mark used for its Irish whiskey and rum products was copied by the defendants using an almost identical mark "Untameable." The plaintiff alleges said act has caused substantial damage to it. 

The plaintiff holds Bacardi & Co. Limited, Bacardi U.S.A. Inc. and Bacardi Limited responsible because the defendants allegedly deprived plaintiff of its full rights to its registered mark and infringed on plaintiff's marketing plan to use as their own.

The plaintiff requests a trial by jury and seeks permanent injunction, monetary award, disgorgement of any profits, damages, costs of action, attorneys' fees and other relief as the court deems proper.
