Liberty Life Assurance Co. allegedly denied disability payments

SAN DIEGO — A woman has filed suit against an insurance company for allegedly being denied long-term disability payments she claims she qualified for.

Kathryn Teincuff filed a complaint on Aug. 12 in U.S. District Court for the Southern District of California against Liberty Life Assurance Co. of Boston, alleging that the plan administrator failed to uphold the rights of the plaintiff under Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on July 21, 2015, she suffered after being denied plan coverage by the defendant despite the plaintiff's alleged disabled condition as defined by the long-term disability plan. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly refused to pay benefits to the plaintiff in accordance with the plan.

The plaintiff requests a trial by jury and seeks judgment against the defendant, declaration of coverage, past-due benefits, interest, attorney's fees, costs of suit and other relief as the court deems appropriate. She is represented by Joshua M. Bonnici of Bonnici Law Group APC in San Diego.
