County of Tulare accused of not paying employees overtime wages

SACRAMENTO – A county of Tulare employee alleges he was underpaid for working overtime and has filed a class-action suit.

Henry Seguin filed a complaint on behalf of all similarly situated individuals on Aug. 25 in the U.S. District Court for the Eastern District of California against the county of Tulare alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid at the rate for overtime compensation. The plaintiff holds the county of Tulare responsible because the defendant allegedly failed to pay overtime premiums at a rate of time-and-one-half to plaintiff for all hours worked that exceeds 40 per week.

The plaintiff seeks unpaid overtime compensation and interest, liquidated damages in an equal amount, injunctive relief, all legal fees and any other relief as the court deems just. He is represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt in Sacramento.
