AT&T Mobility Services allegedly denied former employee medical leave

SACRAMENTO — A sales associate has filed suit against his former employer for allegedly denying him time off work under the Family and Medical Leave Act.

Matthew Agar filed a complaint on Aug. 24 in U.S. District Court for the Eastern District of California against AT&T Mobility Services LLC and Does 1-10, alleging that they terminated the plaintiff's employment as retaliation for taking medical leave.

According to the complaint, the plaintiff alleges that between June 2013 and July 2016, he experienced discrimination due to his disability and was ultimately terminated from his employment. The plaintiff holds AT&T Mobility Services LLC and Does 1-10 responsible because the defendants allegedly denied the plaintiff's request for a family and medical leave and retaliated against him for taking time off work.

The plaintiff requests a trial by jury and seeks compensatory, special and general damages, lost wages and related benefits, punitive and exemplary damages, a penalty of $750, all legal fees and interest and any other relief as the court deems appropriate. He is represented by Nicholas J. Scardigli and Derick E. Konz of Mayall Hurley P.C. in Stockton.
