Mother, child allege negligence against midwives, doctors, Sutter Davis Hospital for birthing accident

SACRAMENTO — A mother and her child have filed suit against midwives, physicians and medical facilities for the allegedly injuries caused to her child during birth.

Liliya Tovmassian and A.T., a minor child, filed a complaint Aug. 25 in U.S. District Court for the Eastern District of California against Blanche Skubic C.N.M., Communicare Health Centers, Sutter Health Sacramento Sierra Region, doing business as Sutter Davis Hospital, Sutter Medical Group, Susan Maayah M.D., and Does 1 through 40, hospital and its doctors, alleging that they failed to properly deliver the plaintiff's child A.T.

According to the complaint, the plaintiffs allege that in March 2014, Liliya Tovmassian was told to stand up during delivery and her infant allegedly was delivered onto the unpadded hospital floor, resulting in a skull fracture and brain injury to the infant. The plaintiffs hold the defendants responsible because the defendants allegedly failed to properly diagnose Liliya Tovmassian's condition and attempted to deliver her unborn child without proper safeguards and precaution.

The plaintiffs request a trial by jury and seek general damages, all legal fees and any other relief as the court deems just. They are represented by Joseph A. Androvich of Poswall, White & Brelsford in Sacramento.
