City of Folsom allegedly failed to pay employees overtime wages

SACRAMENTO -- A former employee has filed a class-action lawsuit against the city of Folsom, alleging he and others were not paid overtime wages they had earned.

Brian Thomas filed a complaint on behalf of all similarly situated individuals on Aug. 25 in U.S. District Court for the Eastern District of California against the city of Folsom, alleging that the employer failed to fairly compensate the plaintiffs for their work.

According to the complaint, plaintiff Thomas alleges that he worked for more than 40 hours without being paid any overtime compensation. The plaintiff holds the city of Folsom responsible because the defendant allegedly failed to pay any overtime premium to the plaintiff for all hours worked exceeding 40 per week.

The plaintiff seeks unpaid overtime compensation and interest, liquidated damages in an equal amount, injunctive relief, all legal fees and interest and any other relief as the court deems appropriate. He is represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt APC in Sacramento.
