CVS Pharmacy allegedly contacted consumer repeatedly on his cellphone

SAN FRANCISCO — An individual claims a pharmacy allegedly violated telephone harassment statutes by repeatedly contacting him about a prescription.

Michael St. Clair filed a complaint on Aug. 26 in U.S. District Court for the Northern District of California against CVS Pharmacy Inc., alleging that the business entity placed repeated phone calls to the plaintiff's cellphone in an attempt to convey medical information.

According to the complaint, the plaintiff alleges that in March 2016, he suffered damages from being called several times on his cellphone. The plaintiff holds CVS Pharmacy Inc. responsible because the defendant allegedly used an automatic telephone dialing system to contact the plaintiff despite his request to stop calling him.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each call, treble damages and any other relief as the court deems appropriate. He is represented by Trinette G. Kent of Lemberg Law LLC in Phoenix.
