Individuals allege they were misclassified as independent contractors for Try Caviar

SAN FRANCISCO – A class-action suit has been filed against a San Francisco business on behalf of its food delivery couriers over allegations it violated wage and hour laws.

Nadezhda Rosen and La'Dell Brewster filed a complaint on behalf of all others similarly situated on Aug. 29 in the U.S. District Court for the Northern District of California against Caviar Inc., doing business as Try Caviar, citing the Unfair Competition Law and other counts.

According to the complaint, the plaintiffs allege that between September 2014 and 2016, they suffered damages from being not being reimbursed for necessary business expenditures to perform their duties as food delivery couriers for the defendant. The plaintiffs holds Caviar Inc. responsible because the defendant allegedly classified the plaintiffs as independent contractors in order to avoid reimbursing them for expenses they paid and also did not provide itemized wage statements.

The plaintiffs seek compensatory damages, all expenses owed, all legal fees and interest plus any other relief as the court deems just. They are represented by Michael Freedman of Lichten & Liss-Riordan PC in San Francisco and Shannon Liss-Riordan and Jill Kahn of Lichten & Liss-Riordan PC in Boston.
