Seaside Integrative Medical Center accusing of violating Uniformed Services Employment and Reemployment Rights Act

SAN DIEGO – A military member alleges that her position was filed by her employer while she was on duty.

Allyson Reynante filed a complaint on Aug. 31 in the U.S. District Court for the Southern District of California against Seaside Integrative Medical Center Inc. and Steven and Linette Williamson citing the Uniformed Services Employment and Reemployment Rights Act.

According to the complaint, the plaintiff alleges that in 2015, she was hired by defendants. The plaintiff is enlisted in the Washington Army National Guard and was called for service from October 2015 to February, the suit states, with breaks for the holidays. She alleges that when she contacted the defendants in November 2015 about her shift, she was told her position was no longer available because the defendants had hired other employees.

The plaintiff requests a trial by jury and declaration that the defendants violated the USERRA, provide employment benefits denied, award fees and expenses, attorneys’ fees, interest, damages, costs of suit and further relief as may be just. She is represented by Brian J. Lawler of Pilot Law PC in San Diego.
