Couture Textile claims apparel companies used fabric design without authorization

LOS ANGELES – A Los Angeles textile company alleges its fabric designs were used in garments without its permission.

Couture Textile Inc. filed a complaint on Aug. 31 in the U.S. District Court for the Central District of California against Cleo Patra Jeans Inc., CLO Apparel Inc., Rainbow Apparel Distribution Center Corp., Anttoi Corp. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its textile design known as MA130947 infringed. The plaintiff holds the defendants responsible because the defendants allegedly sells garments bearing confusingly similar designs as plaintiff's through online and retail stores.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's copyright, award all profits to plaintiff, statutory damages, all legal fees and any other relief as the court deems just.
