Malibu Media claims BitTorrent user is distributing movies without permission

SAN DIEGO – A media company alleges an unidentified internet user in the court's district has been illegally distributing its movies online.

Malibu Media LLC, doing business as X-Art.com, filed a complaint on July 25 in the U.S. District Court for the Southern District of California, San Diego Division against John Doe subscriber assigned IP address 107.135.65.209 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it owns the copyrights to the original works that the defendant copied and distributed to the BitTorrent file distribution network without plaintiff's permission. 

The plaintiff holds John Doe subscriber assigned IP address 107.135.65.209 responsible because the defendant allegedly violated plaintiff’s exclusive rights to reproduce, redistribute, perform and display its copyrighted works.

The plaintiff requests a trial by jury and seeks to enjoin defendant from further infringement, order deletion of the digital media files in its possession, statutory damages, attorney’s fees, costs and further relief the court deems just.
