California Expanded Metal Products Co. allegedly discharged pollutants into the San Gabriel River

LOS ANGELES — A citizen has filed suit against a metal products company for allegedly violating federal law for discharging pollutants into the San Gabriel River. 

Luke Delgadillo Garcia filed a complaint Sept. 2 in U.S. District Court for the Central District of California against California Expanded Metal Products Co., alleging that the California corporation discharges polluted stormwater from their facility into the San Gabriel River.

According to the complaint, the plaintiff alleges that he suffered damages. The plaintiff holds California Expanded Metal Products Co. responsible because the defendant allegedly failed to implement certain safeguards to lessen the pollutants being discharged from their facility into the San Gabriel River.

The plaintiff seeks to enjoin the defendant, order the defendant to restore all water damaged, pay civil penalties of up to $37,500 per day, all legal fees and any other relief as the court deems just. He is represented by Evan J. Smith and Ryan Cardona of Brodsky & Smith LLC in Beverly Hills.
