Consumer alleges debt collectors would not accept payment to settle debt

LOS ANGELES – A consumer alleges two debt collectors refused to honor their agreement with her to settle a debt.

Maureen Kawecki filed a complaint on Sept. 7 in the U.S. District Court for the Central District of California against Pinnacle Credit Services LLC, Vision Financial Corp. and United Collection Bureau Inc. citing breach of contract, violation of the Fair Debt Collection Practices Act and other counts.

According to the complaint, the plaintiff alleges that in March, she and Pinnacle, on behalf of Vision, agreed to a settlement agreement for plaintiff's account with Pinnacle for two monthly payments of $248.31. The suit states the first payment was made on March 31 but that Pinnacle and Vision did not accept the second.

The plaintiff holds Pinnacle Credit Services LLC, Vision Financial Corp., and United Collection Bureau Inc. responsible because the defendants allegedly breached their settlement agreement with plaintiff by refusing to accept any payment after the first payment was made.

The plaintiff seeks actual monetary damages, statutory damages, all legal fees and any other relief as the court deems just. She is represented by Jennifer Tunder of Aries Law Firm PLLC in Oklahoma City, Oklahoma and of Reznick Law Firm PLLC in New York, New York.
