LOS ANGELES – A city truck driver for FedEx alleges his insurer wrongfully terminated his disability benefits.
Edward Henderson filed a complaint on Sept. 8 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in August 2014, he became disabled and was initially being paid disability benefits until it was terminated on Oct. 1, 2015, by the defendant. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld their decision to deny plaintiff's disability benefits despite still being disabled according to the terms of the plan.
The plaintiff seeks award of benefits plaintiff is entitled to plus interest, all other benefits from the plan plaintiff is entitled to, determine that plaintiff is entitled to future disability benefits, all legal fees and any other relief as the court deems just.
