Bosco's Bones & Brew accused copyright infringement over song performances

SAN FRANCISCO – The owners of copyrighted music allege a Sunol business has been performing its compositions without a license.

Broadcast Music Inc., Universal - Songs of Polygram International Inc., Alley Music Corp., et al. filed a complaint on Sept. 12 in the U.S. District Court for the Northern District of California against Alevamare Inc., doing business as Bosco's Bones & Brew, Allen Feng and Mary Troung alleging copyright infringement.

According to the complaint, the plaintiffs allege that since August 2013, they have reached out to defendants numerous times, by phone, mail and email, in an effort to educate defendants as to their obligations under the Copyright Act of purchasing a license for the public performance of musical compositions of plaintiffs. The plaintiffs hold Alevamare Inc., Feng and Troung responsible because the defendants allegedly failed to uphold rights of plaintiffs by performing compositions without authority and obtained profit at the expense of plaintiffs.

The plaintiffs seek judgment in their favor, to restrain the defendants from further infringement, damages, costs, attorney's fees and further relief as is just. They are represented by Karen S. Frank and Thomas A. Harvey of Coblentz Patch Duffy & Bass LLP in San Francisco.
