Photographer accuses eBay sellers of copyright infringement

LOS ANGELES – A photographer alleges unauthorized copies of his works were sold on eBay.

Barry Rosen filed a complaint on Sept. 12 in the U.S. District Court for the Central District of California against Brian Gray, doing business as American Icons Texas; Leaf Trading Cards LLC; Jonathan "Jon" Rademacher; Dan Schwartz and Scott Schwartz, doing business as Baseball Cards Movie Collectibles; and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that the defendants have made and sold on eBay a painting of one of his photographs of Ali Landry on a trading card and copies of his photographs of Daisy Fuentes without his permission. The plaintiff holds the defendants responsible because the defendants allegedly used and distributed unauthorized copies of plaintiff's copyrighted photographs.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, interest, enjoin the defendant from further infringing plaintiff's works, all legal fees and any other relief as the court deems just. He is representing himself.
