Man alleges he is owed disability benefits from Hartford Life, employer's plan

SAN FRANCISCO – A man has filed suit to collect disability benefits he alleges he was owed.

Dave Nagy filed a complaint on Sept. 16 in the U.S. District Court for the Northern District of California against Group Plan for Employees of Oracle America Inc. and Hartford Life and Accident Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in Sept. 12, 2011, he became disabled and applied for disability benefits, which were denied in January 2013. The suit states he filed a suit against the defendants and was awarded own occupation benefits in June. He alleges he was damaged from the loss of benefits from December 2011 to the present date.

The plaintiff seeks benefits due under the plan in the amount of $571,048 plus interest of 10 percent per annum, attorney's fees of $250,000 and any other relief as the court deems just. He is represented by Laurence F. Padway of Law Offices of Laurence F. Padway in Alameda.
