Tourism Ireland retiree alleges insurance terms were changed after retirement

SANTA ANA – A retiree is suing his former employer alleging it changed his health benefits after retiring despite of a contract.

Thomas Heneghan filed a complaint on Sept. 21 in the U.S. District Court for the Central District of California, Southern Division against Tourism Ireland and Does 1-10 alleging breach of contract, fraud, negligent and other counts.

According to the complaint, the plaintiff alleges that in 1974, he started working for Bord Failte, of which the defendant is a successor. The suit states upon his retirement, Blue Cross/Blue Shield would provide health insurance for him and his family. However, in 2012, two years after his retirement, plaintiff was allegedly informed that the defendant was revoking his post-employment insurance contribution rights.

The plaintiff holds Tourism Ireland and Does 1-10 responsible because the defendants allegedly failed to provide plaintiff a proper reason for denial of benefits, failed to furnish complete plan documents within 30 days of plaintiff’s written request and attempted to modify conditions of plaintiff's post-employment health insurance benefits.

The plaintiff requests a trial by jury and seeks judgment in his favor, injunctive relief, medical benefits, penalties, attorney's fees, costs and other relief as the court deems just. He is represented by Christopher D. Nissen of Nissen Law Firm in Los Angeles.
