Yelete Group Inc., Zulily LLC accused of copyright infringement over textile design

LOS ANGELES – The Los Angeles-based owner of two-dimensional graphic artworks used in textiles and clothing alleges a Commerce company and a Seattle company have used its design without permission.

Unicolors Inc. filed a complaint on Sept. 21 in the U.S. District Court for the Central District of California against Yelete Group Inc., Zulily LLC and Does 1-10, alleging that the individuals knowingly engaged in copyright infringement.

According to the complaint, the plaintiff alleges that on Feb. 14, 2011, it was granted copyright registration for its two-dimensional artwork called EH101 for use on textiles. It alleges that the defendants have infringed on plaintiff's property by importing, producing, distributing and/or selling infringing garments through a nationwide network of retail stores, catalogues and online websites.

The plaintiff holds Yelete Group Inc., Zulily LLC and Does 1-10 responsible because the defendants allegedly committed infringement with knowledge of plaintiff's rights and existence, obtained profit at the expense of plaintiff and introduced infringing products into the stream of commerce.

The plaintiff requests a trial by jury and seeks judgment in its favor, enjoin defendants from further infringement, profits, losses, attorney's fees, interest, costs of suit and further relief as the court deems proper. It is represented by C. Yong Jeong of Jeong & Likens LC in Los Angeles.
