SAN JOSE – A New York man alleges a Sunnyvale corporation failed to properly secure its users' personal information and has filed a class-action suit.

Ronald Schwartz filed a complaint on behalf of all others similarly situated on Sept. 23 in the U.S. District Court for the Northern District of California, San Jose Division against Yahoo! Inc. alleging gross negligence.

According to the complaint, the plaintiff alleges that he suffered damages from having his personal information stolen in a 2014 data breach that was announced in September. The plaintiff holds Yahoo! Inc. responsible because the defendant allegedly failed to implement necessary steps in securing plaintiff's personal information.

The plaintiff requests a trial by jury and seeks damages, injunctive and equitable relief, all legal fees plus interest and any other relief as the court deems just. He is represented by Shawn A. Williams of Robbins Geller Rudman & Dowd LLP in San Francisco, Paul J. Geller and Stuart A. Davidson of Robbins Geller Rudman & Dowd LLP in Boca Raton, Florida; and Joel H. Bernstein, Corban S. Rhodes and Ross M. Kamhi of Labaton Sucharow LLP in New York.
