New York man claims Yahoo data breach affected his accounts

SAN FRANCISCO – A New York individual has filed a class-action lawsuit against a Sunnyvale company over allegations that his personal information was put a risk in a recent data breach.

Edward McMahon filed a complaint on behalf of all others similarly situated on Sept. 24 in the U.S. District Court for the Northern District of California against Yahoo! Inc. alleging breach of implied contract, negligence and unfair competition.

According to the complaint, the plaintiff alleges that he suspects his account was breached in a 2014 data breach that the defendant announced in September. He alleges he has lost access to some of his accounts and believes hackers have changed the passwords. The plaintiff holds Yahoo! Inc. responsible because the defendant allegedly failed to implement necessary steps in securing plaintiff's personal information.

The plaintiff requests a trial by jury and seeks enjoin the defendant, equitable relief, restitution, disgorgement, actual damages, compensatory damages, all legal fees and any other relief as this court deems just.
