Faulty furnace prompts glass company to file suit against others

SACRAMENTO — A California business has filed suit against several other businesses for alleged breach of contract, breach of warranty, negligence and product liability regarding a faulty furnace.

Gallo Glass Co. filed a complaint Sept. 28 in U.S. District Court for the Eastern District of California against Special Shapes Refractory Co. Inc. and Nikolaus Sorg GMBH & Co. KG,   alleging that they failed to properly construct and maintain the plaintiff's Furnace No.4 project.

According to the complaint, the plaintiff alleges that earlier this year, Gallo Glass Co. suffered damages to its business as the result of having to purchase glass products from outside sources and make repairs to its furnace. The plaintiff holds Special Shapes Refractory Co. Inc. and Nikolaus Sorg GMBH & Co.KG responsible because the defendants allegedly failed to make sure that the construction and materials used in constructing the plaintiff's furnace wouldn't fail.

The plaintiff requests a trial by jury and seeks general damages, direct damages, special and consequential damages, interest, all legal fees and any other relief as the court deems just.
