Papermill Printing Inc. accused of not paying withdrawal liability

WESTERN – A labor group alleges an inactive corporation did not pay back a withdrawal liability.

GCIU-Employer Retirement Fund and board of trustees of the GCIU-Employer Retirement Fund filed a complaint on Sept. 27 in the U.S. District Court for the Central District of California against Papermill Printing Inc. alleging violation of the Employment Retirement Income Security Act.

According to the complaint, the defendant withdrew from participation in the plaintiffs' funds in 2009. The plaintiffs allege that they sent the defendant a notice of withdrawal liability and demand for payment, but the defendant has failed to pay. The plaintiffs also seek an audit of the defendant's records.

The plaintiffs seek past due withdrawal liability payment of $267,352, interest, all legal fees, all due contributions plus interest, liquidated damages and any other relief as the court deems just. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
