Man alleges Fifth Third Bank has called more than 100 times trying to reach another person

LOS ANGELES – A North Hollywood consumer is suing a bank over allegations it invaded his privacy by contacting him repeatedly in an attempt to reach another person.

Parham Javaheripur filed a complaint on Sept. 27 in the U.S. District Court for the Central District of California against Fifth Third Bank and Does 1-5 alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that, between June 2015 and May 2016, the defendant called his cellphone at least 174 times in an attempt to collection a debt from an unknown person to the plaintiff. The plaintiff holds Fifth Third Bank; and Doe 1-5 responsible because the defendants allegedly used an automatic telephone dialing system to contact plaintiff and have invaded his privacy.

The plaintiff requests a trial by jury and seeks statutory damages of more than $87,000, punitive damages, all legal fees and interest plus any other relief as the court deems just. He is represented by Robert Amador of Centennial Law Offices in Ventura.
