United of Omaha Life Insurance Co. alleged to have wrongfully denied LA man's benefits

Insurance 04

LOS ANGELES – A Los Angeles man alleges an insurance firm wrongfully denied his claim for disability benefits.

Gannon Gray filed a complaint on Oct. 3 in the U.S. District Court for the Central District of California against United of Omaha Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2011, he became disabled because of injuries sustained in a car accident and applied for disability benefits in 2015, which were denied. The plaintiff holds United of Omaha Life Insurance Co. responsible because the defendant allegedly upheld its decision to deny plaintiff any disability benefits without looking at his medical records over claims that the plaintiff's claim was untimely per the terms of the plan.

The plaintiff seeks payment of disability benefits to plaintiff, order that plaintiff is entitled to receive disability benefits for as long as he is disabled, all legal fees and interest plus any other relief as this court deems just. He is represented by Russell G. Petti of The Law Offices of Russell G. Petti in La Canada.
