Driver alleges Arthur D. Barnes Inc. owes unpaid wages

LOS ANGELES – A driver for a Torrance trucking company alleges he was not properly compensated for all hours worked.

Daryl Coates filed a complaint on Oct. 7 in the U.S. District Court for the Central District of California, Western Division against Arthur D. Barnes Inc. and Ivan Barnes citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation, a minimum wage or provided an itemized wage statement. The plaintiff claims these allegations are in violation of the FLSA.

The plaintiff requests a trial by jury and seeks damages for unpaid overtime in an amount that exceeds $90,000; liquidated damages; unpaid minimum wages in excess of $5,000; damages in an amount of $7,200; $750 for failure to allow plaintiff to inspect or copy records in a timely manner; restitution and disgorgement; interest, all legal fees; and any other relief as the court deems just.
