LOS ANGELES – A California corporation alleges two of its fabric designs were copied without its permission for use in garments.
Italian Connection Inc., doing business as Bila of California, filed a complaint on Oct. 5 in the U.S. District Court for the Central District of California against the Bizz Inc., individually and doing business as En Creme; Nordstrom Inc.; Irene's Story; No Rest for Bridget; South Moon Under Inc.; and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its WU and FA Prints copied for use in garments. The plaintiff holds Bizz Inc., individually and doing business as En Creme; Nordstrom Inc.; Irene's Story; No Rest for Bridget; South Moon Under Inc.; and Does 1 through 10 responsible because the defendants allegedly used their retail stores and online websites to distribute the infringing garments.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's designs, award all profits to plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just.
